Terms of Service

1. Agreement to Terms

By accessing or using Clear Quote ("the Service"), operated by Clear Quote Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Clear Quote is an AI-powered platform that helps homeowners request quotes from contractors. The Service uses automated voice calls, SMS, and email to contact contractors on your behalf, collect quotes, and facilitate communication between homeowners and contractors.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

4. Credits and Payments

The Service operates on a credits-based system. Credits are purchased in advance and deducted when outreach campaigns are started. Credits are non-refundable except where unused credits remain from a cancelled campaign, in which case unused credits will be returned to your account balance. All payments are processed through Stripe. Prices are subject to change with notice.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Submit false, misleading, or fraudulent project information
  • Harass, abuse, or harm contractors contacted through the Service
  • Attempt to circumvent any security features or usage limits
  • Use the Service to collect contractor information for purposes unrelated to obtaining quotes
  • Resell or redistribute the Service without our written consent

6. Automated Communications

By using the Service, you authorize Clear Quote to make automated voice calls, send SMS messages, and send emails to contractors on your behalf. You represent that the project information you provide is accurate and that you have a legitimate interest in obtaining contractor quotes for the described work. We maintain compliance with applicable telecommunications regulations including the Telephone Consumer Protection Act (TCPA).

7. Contractor Relationships

Clear Quote facilitates introductions between homeowners and contractors. We do not employ, endorse, or guarantee any contractor. We are not a party to any agreement between you and a contractor. You are solely responsible for evaluating contractors, verifying their credentials, and negotiating terms of service with them.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any specific number of contractors will respond to your requests. We do not guarantee the accuracy, quality, or reliability of any quotes received through the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Clear Quote Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Clear Quote Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Any unused credits at the time of termination for cause are forfeited.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. SMS Messaging Terms

Program Name: ClearQuote Contractor Outreach

Description: By engaging with the ClearQuote platform — including during AI-powered phone calls or by calling back our platform number — contractors may receive SMS messages containing project details, callback phone numbers, appointment confirmations, project photo links, and quote summaries related to homeowner service requests.

Message Frequency: Message frequency varies based on project activity. Typically 1–5 messages per project interaction. No recurring marketing messages are sent.

Message and Data Rates: Message and data rates may apply. Check with your carrier for details.

Opt-Out: You can opt out of SMS messages at any time by replying STOP to any message. You will receive a confirmation message and no further messages will be sent. You may also request removal during any phone call with our system.

Supported Carriers: Compatible with all major US carriers including AT&T, Verizon, T-Mobile, and Sprint.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
